OBARO GROBLERSDAL’S PROMOTION – TERMS AND CONDITIONS

1. The promoter of the promotion is OBARO Retail (Pty) Ltd, Groblersdal branch (“OBARO”) with company registration number: 1998/001675/07 with registered address situated at C/o Graham and Silverlakes Road, Silverlakes, Pretoria, 0081 
2. Entry into the promotions will be deemed acceptance of these rules, terms and conditions as stipulated herein. 
3. The promotion is exclusive to OBARO’s Groblersdal branch.  
4. The promotion is exclusive to South African residents who is 18 years or older, unless stated otherwise, and is closed to any person who are directors, members, partners, employees, agents or consultants of or any other person who directly or indirectly controls or is controlled by the OBARO or marketing service providers, or spouses, life partners, business partners or immediate family members. In addition, all OBARO employees are precluded from participation in the promotion.  
5. OBARO reserves the right to cancel, suspend or amend the rules, terms and conditions of the promotion at any time. Any changes to the promotion will be notified to the participant(s) as soon as reasonable possible. 
6. The promotion period will run from 15 August 2023 to 30 November 2023 (“promotion period”). 
7. In the event of any dispute relating to the promotion, the decision of OBARO shall be final and no correspondence or discussion shall be entered into with a participant(s). 
8. A participant(s) may enter the promotion as many times as the participant(s) like but will only be eligible to win 1 (one) prize.  
9. By participating in the promotion, the participant agrees to release and hold OBARO harmless from any and all losses, harm, damages, rights, claims and actions of any kind in connection with the promotion or resulting from their participation in the promotion, including, without limitation, personal injuries, death and property damage, and claims based on publicity rights, defamation or invasion of privacy. 
10. In the event where the promotion is cancelled or suspended, the participant(s) agree to waive any rights that they may have in terms of the promotion and acknowledge that they have no recourse against OBARO, their employees, agents, partners, suppliers, sponsors or promoters. 
11. To enter the promotion, the participant must during the promotion period: Buy any three OBARO branded products at OBARO Groblersdal; The participant must include his/her name, surname and contact details at the point of purchase.  
12. OBARO and its sub-contractors are not responsible for lost, delayed, misdirected, unintelligible or incomplete electronic mail, telephone, post, electronic hardware and software programs, network, internet and computer malfunctions, delays, failures and difficulties, errors in transmission or any condition caused by events beyond the control of OBARO, which may cause the promotion to be disrupted or corrupted. 
13. One (1) winner will be selected from the participants who enter the promotion during the promotion period. 
14. The winner will receive a 45 litre Romer cooler. 
15. The winner will be selected by random draw using the online platform. In the event of technical failure utilized to facilitate the random draw, irrespective of the cause thereof, another suitable device or method may be used at the sole discretion of OBARO.  
16. OBARO will take all reasonable steps to announce the winners on the day of the event, alternatively the winner will be notified telephonically, subsequent to the promotion period.  
17. All prize(s) will be delivered to the winner(s) in a manner as determined by the OBARO, in its sole discretion. 
18. Prize(s) are not transferable and may not be exchanged for cash unless otherwise advertised. Prize(s) are subject to availability and OBARO reserve the right to substitute any prize(s) with another of equivalent value without giving notice. 
19. Winners may be asked to take part in reasonable publicity relating to the promotion. OBARO reserves the right to publish the name(s), surname(s) and/or photograph(s) of the winner(s), and the winner(s) hereby consents to such publication. 
20. The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other social media platform.  
21. OBARO reserves the right to request personal information from the participant(s) as it may be deemed necessary for the participant(s) to receive the prize(s). The information provided by the participant(s) will be used in conjunction with OBARO’s Privacy Policy, which can be sourced at https://OBARO.co.za/privacy-policy. 
22. By virtue of participation, participant(s) consent to OBARO obtaining, processing and retaining their personal information (“Personal Information”), which may include the involvement of OBARO’s third-party agent. Also, participant(s) consent to OBARO retaining their Personal Information for as long necessary to further the legitimate business interests of OBARO and that OBARO may take reasonable steps to update or destroy such information. 
23. Participant(s) accept that OBARO takes reasonable and practical steps to safeguard their Personal Information in its possession. In addition, errors or malfunctions can occur. To the fullest extent permissible by law, participant(s) hereby indemnify and hold harmless OBARO, its employees and agents against any liability, damages and/or legal action whatsoever and howsoever arising, including negligence on the part of OBARO, its employees or agents and OBARO shall not accept liability for any damages, or any type of loss suffered by participants who enter the promotion. 
24. In the event that any participant(s) wishes to object to the processing of his or her Personal Information, which right the participant(s) is at all times entitled to exercise, the participant(s) must direct such a request to OBARO’s Information Officer at the following email address: [email protected] 
25. In the event that OBARO makes any indulgence or deviation of these terms and conditions in favour of participant(s), then such indulgence or deviation shall not be misconstrued to be a breach or waiver of these terms and conditions or any rights of OBARO. 
26. The above clauses are severable from each other. In the event that any clause or part thereof is unenforceable in law, then that clause or part thereof shall be severed from these terms and conditions, and the surviving clauses and parts thereof shall remain in force.
