OBARO RETAIL (HARTBEESPOORT BRANCH) MONTEGO COLOUR IN COMPETITION – TERMS AND CONDITIONS

  1. The promoter of the competition is the OBARO Retail (Pty) Ltd, Hartbeespoort branch (“OBARO”) with company registration number: 1998/001675/07 with registered address situated at c/o Graham and Silverlakes Road, Silverlakes, Pretoria, 0081.
  2. Entry into the competition will be deemed acceptance of the rules, terms and conditions as stipulated herein.
  3. The competition is exclusive to OBARO’s Hartbeespoort branch.
  4. The competition is closed to any participants over 13 years of age, directors, members, partners, employees, agents or consultants of OBARO or any other person who directly or indirectly controls or is controlled by OBARO or its marketing service providers, or spouses, life partners, business partners or immediate family members. In addition, all OBARO employees are precluded from participation in the competition.
  5. Participants of the competition are minors and may only participate with the consent of a parent and/or guardian.
  6. OBARO reserves the right to cancel, suspend or amend the rules, terms and conditions of the competition at any time. Any changes to the competition will be notified to the participant(s) as soon as reasonable possible.
  7. The competition will run from 19 July 2023 to 29 July 2023 (“competition period”).
  8. In the event of any dispute relating to the competition, the decision of OBARO shall be final and no correspondence or discussion shall be entered into with any participant(s).
  9. A participant(s) may only enter the competition once and will only be eligible to win 1 (one) prize.
  10. By participating in the competition, the participant agrees to hold OBARO harmless from any and all claims and actions of any kind resulting from their participation in the competition, including, without limitation, personal injuries, death and property damage, and claims based on publicity rights, defamation or invasion of privacy.
  11. In the event where the competition is cancelled or suspended, the participant(s) agree to waive any rights that they may have in terms of the competition and acknowledge that they have no recourse against OBARO, their employees, agents, partners, suppliers, sponsors or promoters.
  12. To enter the competition, the participant must during the competition period:

12.1.Complete a colouring picture provided by OBARO Hartbeespoort;

12.2.The completed colouring picture must be submitted at OBARO Hartbeespoort, situated at The Handelspost Centrum, Hartbeespoort before 13h00 on the closing day of the competition (29 July 2023).

  1. OBARO and its sub-contractors are not responsible for lost, delayed, misdirected, unintelligible or incomplete contact details, which may cause the competition to be disrupted.
  2. Three winners will be selected from the participants who enter the competition during the competition period.
  3. Each winner will receive a share of a Bags O Wags Assorted Treats prize to the total value R270,00, each.
  4. The winner will be selected by the public who will vote on the Facebook page of Harties Feral and Cat Rescue (“Harties Feral”).
  5. The winner/s will be notified telephonically by Harties Feral.
  6. All prize(s) will be delivered to the winner(s) in a manner as determined by OBARO, in its sole discretion.
  7. Prize(s) are not transferable and may not be exchanged for cash unless otherwise Prize(s) are subject to availability and OBARO reserves the right to substitute any prize(s) with another of equivalent value without giving notice.
  8. Winners may be asked to take part in reasonable publicity relating to the competition. OBARO reserves the right to publish the name(s), surname(s) and/or photograph(s) of the winner(s), and the winner(s) hereby consents to such publication.
  9. The competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other social media platform.
  10. OBARO reserves the right to request personal information from the participant(s) as it may be deemed necessary for the participant(s) to receive the prize(s). The information provided by the participant(s) will be used in conjunction with OBARO’s Privacy Policy, which can be sourced at https://OBARO.co.za/privacy-policy.
  11. By virtue of participation, participant(s) consent to OBARO obtaining, processing and retaining their personal information (“Personal Information”), which may include the involvement of OBARO’s third-party agent. Also, participant(s) consent to OBARO retaining their Personal Information for as long necessary to further the legitimate business interests of OBARO and that OBARO may take reasonable steps to update or destroy such information.
  12. Participant(s) accept that OBARO takes reasonable and practical steps to safeguard their Personal Information in its possession. In addition, errors or malfunctions can to the fullest extent permissible by law, participant(s) hereby indemnify and hold harmless OBARO, its employees and agents against any liability, damages and/or legal action whatsoever and howsoever arising, including negligence on the part of OBARO, its employees or agents and OBARO shall not accept liability for any damages, or any type of loss suffered by participants who enter the competition.
  13. In the event that any participant(s) wishes to object to the processing of his or her Personal Information, which right the participant(s) is at all times entitled to exercise, the participant(s) must direct such a request to OBARO’s Information Officer at the following email address: [email protected]
  1. In the event that OBARO makes any indulgence or deviation of these terms and conditions in favour of participant(s), then such indulgence or deviation shall not be misconstrued to be a breach or waiver of these terms and conditions or any rights of OBARO.
  2. The above clauses are severable from each other. In the event that any clause or part thereof is unenforceable in law, then that clause or part thereof shall be severed from these terms and conditions, and the surviving clauses and parts thereof shall remain in force.

  1. OBARO shall take all reasonable measures to protect the personal information of users of this platform and for the purpose of this disclaimer “personal information” shall have the meaning ascribed to it in the Promotion of Access to Information Act, Act 2 of 2000 (PAIA) and POPI. The acts are available online at www.gov.za/documents/acts.
  2. OBARO collects personal information from users of this platform to conduct criminal, credit, employment reference and other related reference checks and to verify your qualifications.
  3. All personal information collected by OBARO will be stored in a secure and safe manner according to strict information security principles, with safeguards to ensure its privacy and confidentiality, for no longer than is necessary to achieve the purpose for which it was collected, unless further retention is required by law or contractual obligation, after which the information will be de-identified.
  4. OBARO will not disclose your personal information, unless legally permitted thereto and you have the right to access your personal information collected by OBARO, to update your personal information and to object to Obaro processing your personal information.
  5. OBARO accepts no liability whatsoever for any loss, damage (whether direct, indirect, special or consequential) and/or expenses of any nature whatsoever which may arise as a result of, or which may be attributed directly or indirectly to personal information made available on this platform, or actions resulting therefrom.
