OBARO BROKERS
1. The promoter of the project is OBARO Brokers (Pty) Ltd, (“OBARO Brokers”) with company registration number: 2005/003321/07 with registered address situated at C/o Graham and Silverlakes Road, Silverlakes, Pretoria, 0081.
2. Employees of the OBARO Group is encouraged to provide leads to OBARO Brokers in respect of short term insurance products, which leads to the acceptance of a policy subject to terms and conditions contained herein.
3. By referring someone you agree to the terms and conditions as stipulated herein.
4. The competition is exclusive to the employees within the OBARO Group.
5. OBARO reserves the right to cancel, suspend or amend the rules, terms and conditions of the project at any time. Any changes to the project will be notified to the participant(s) as soon as reasonable possible.
6. The project period will run from 18 August 2023 to 30 September 2023 (“project period”).
7. The referral of the following short term insurance products will qualify for this project:
7.1 Personal insurance – Building-, content- and motor vehicle insurance;
7.2 Business insurance;
7.3 Crop insurance.
8. In order to quality for the for this project the referred, must not have any current policies that are in force with OBARO Brokers.
9. If the employee has successfully referred a referal to us, the referee must accept an insurance policy with OBARO Brokers. Once OBARO Brokers have successfully collected the full premium amount from the referee’s bank account for the first month, an OBARO online coupon of R250,00 will be provided for each referral. The branch and/or division where the employee is employed will also receive a R250,00 referral fee.
10. The referral must be submitted to [email protected], which referral will be distributed to the brokers of OBARO Brokers in accordance with their respective areas of jurisdiction.
11. In the event of any dispute relating to the project, the decision of OBARO shall be final and no correspondence or discussion shall be entered into with a participant(s).
12. By participating in the project, the employee agrees to release and hold OBARO harmless from any and all losses, harm, damages, rights, claims and actions of any kind in connection with the competition or resulting from their participation in the project, including, without limitation, claims based on publicity rights, defamation or invasion of privacy.
13. In the event where the project is cancelled or suspended, the employee(s) agree to waive any rights that they may have in terms of the competition and acknowledge that they have no recourse against OBARO Brokers, its representatives, divisions, agents, partners, or affiliates.
14. OBARO Brokers and its sub-contractors are not responsible for lost, delayed, misdirected, unintelligible or incomplete electronic mail, telephone, post, electronic hardware and software programs, network, internet and computer malfunctions, delays, failures and difficulties, errors in transmission or any condition caused by events beyond the control of OBARO Brokers, which may cause the project to be disrupted or corrupted.
15. OBARO Online coupons are not transferable and may not be exchanged for cash unless otherwise agreed.
16. OBARO Brokers requires the personal information from the referrals. The employees thus confirm that he/she has obtained the necessary consent from the referral in order for OBARO Brokers to process the referrals personal information. The employee hereby indemnify and holds OBARO Brokers and its representatives, to the fullest extent permissible by law, harmless against any liability, damages and/or legal action whatsoever and howsoever arising, including negligence on the part of OBARO Brokers, its representatives or agents and OBARO Brokers shall not accept liability for any damages, or any type of loss suffered by referral, if the employee failed to obtain the necessary consent.
17. The FAIS Act states that a person who is not an authorised Financial Services Provider (FSP), accredited or is not a mandated representative of a FSP, is not permitted to give advice on financial products or provide any financial intermediary services to any other person. The employee accordingly confirms that he/she will not give advice on any financial products of provide any financial intermediary service and holds OBARO harmless against any failure to comply with the aforesaid.
18. Insurance law prohibits inducement and therefore no employee may offer a referral an incentive to become a policy holder with OBARO Brokers. Therefore an employee may not bring any prospective policy holder under the impression that he/ she may be obliged in any way to take out a policy with us.
19. OBARO Brokers will not be liable for any illegal or unlawful actions or misrepresentations made by the employee to the referee in respect of this service or any product offered by OBARO Brokers.
20. The employee is not mandated to act as a representative, agent or authorised to incur any obligations or liabilities on behalf of OBARO Brokers or to give any warranties, representations or undertakings of any nature.
21. In the event that OBARO Brokers makes any indulgence or deviation of these terms and conditions in favour of participant(s), then such indulgence or deviation shall not be misconstrued to be a breach or waiver of these terms and conditions or any rights of OBARO Brokers.
22. The above clauses are severable from each other. In the event that any clause or part thereof is unenforceable in law, then that clause or part thereof shall be severed from these terms and conditions, and the surviving clauses and parts thereof shall remain in force.
